Put the burden on girls in the locker room fight

Under his approach, female students had to submit "Mental Health Accommodation" or "Religious" paperwork just to avoid sharing a locker room with biological boys. Rather than protecting student privacy by default, the burden was placed entirely on girls to opt out. Parents planned a walkout at James L. Day Middle School over it.

Censured by his own board over threats to a fellow trustee

The TVUSD board formally censured Barham over threats directed at fellow trustee Dr. Melinda Anderson and her husband. A censure is the board publicly rebuking one of its own members — it does not happen over a disagreement.

Threatened a trustee's family business over her votes

He threatened to go after Melinda Anderson's husband's business because she would not vote for or support what he wanted. Retaliation against a colleague's livelihood to win a board vote.

Met privately with a minor student, no adults present

Barham met one-on-one with Nathan Berry, then a minor student and now the sitting student board member. A witness seated at the next table heard most of the conversation, and there is a photo. After this encounter TVUSD had to pass a policy protecting students from private meetings with board members.

Cease-and-desist letters over yard signs

He sent cease-and-desist letters to multiple neighbors who had "RECALL EMIL BARHAM" signs on their own private property. Political signs on your own lawn are about as protected as speech gets.

Defamation threats aimed at parents and neighbors

He has sent several threats of defamation lawsuits to parents and community members for exercising their First Amendment right to oppose his actions and statements. Two of those letters have been answered.
